State v. D.R.—Electrical Field Construction Manager charged with DWI after getting into a fight in a restaurant.

Police called. Client stopped. Admits to drinking beers and a shot of whiskey. Despite telling officer he had severe leg injuries (none of which were in officer’s report, warrant affidavit, or any other paperwork), he agrees to do field tests. Officer says he fails all field tests. Slightly less than three hours after arrest, a blood test showed a BAC of 0.084 (+/- .005). At trial, client’s records admitted to show his extensive leg injuries and prosthetic hip. Also showed critical instrument calibrations had not been done. Jury found client not guilty in 1.5 hours.
