SLF’s Client, a Vice President at a small West Texas operating company, was prosecuted by the Department of Justice’s Environmental and Natural Resources Division (ENRD) from Washington DC. The indictment alleged violations of the Clean Air Act, Safe Water Drinking Act, and alleged our client knowingly caused the death of an employee. After years of work, interviewing witnesses, and assembling the defense for trial, the ENRD offered a plea to a misdemeanor information for a 5-month sentence, and $0 fine.
